LAHAD DATU - A Dangerous Game?

LAHAD DATU: The current drama in Lahad Datu following the incursion of armed men from the Philippines and the government’s “gentle” approach to the situation could backfire on the Barisan Nasional leadership if it is indeed a tactical strategy to scare Sabahans into voting for the ruling coalition.

"If this is the BN game, then it is a dangerous strategy,” said State Reform Party (STAR) chief Jeffrey Kitingan.

"It [the strategy] is a double-edged sword because it can backfire and cause the people to vote against the BN for its obvious failure in flexing the [government's] military muscle for the sake of national dignity and sovereignty.

"If the government cannot protect our country and deal with this problem in a way that will enhance our standing as a sovereign nation, maybe it’s time for Malaysia to ask for international intervention,” Jeffrey said, alluding to the stand-off between police and the militants.

He was commenting on widespread rumours that the government’s “no-bloodshed strategy” could be a tactic to counter the growing political uncertainties in the state.

The protracted “negotiations” between the police and the armed militants – holed up in Felda Sahabat in Lahad Datu – is testing the patience of locals and stoking the ire of villagers barred from entering the cordoned-off areas to carry out their daily routine and economic activities.

It has also not helped that details of the “negotiations” have been withheld from the public, with the mainstream media “advised” to downplay the issue.

Left in the cold, Sabahans have been accessing online portals, blogs, tweets and social media for updates on the incursions, leaving many to spin their own theories over the government’s handling of the issue.

Said Jeffrey: “Why is there little media coverage in the government-controlled mainstream media although the intrusion is bordering on an act of war?

"Isn’t Sabah important enough for all Malaysians to be kept posted on the developments of the standoff? This is not a localised issue.”

"Also, why are the police not taking action on rumours of disturbances in other areas in Sabah? Is it because these rumours are being fired up by [BN] cybertroopers?

"Is this whole thing a scripted charade to frighten the voters?” he asked.

Sabah not a ‘fixed deposit’

It has been more than 10 days since the armed militants – rumoured to be 400 men – first landed in Lahad Datu on Feb 9.

Villagers at Felda Sahabat, where these bandits are holed up, fearing that they were members of the fearsome Abu Sayyaf terrorist group, immediately fled with their families.

They were expecting the army to clamp down on the seige quickly and to be able to return to the homes and routine.

But the stand-off remains with Home Minister Hishammuddin Hussein reportedly saying yesterday that the “situation is under control” and that they were “dealing” with it.

But curious questions over whether the police are equipped to handle such “negotiations with militants” and why the military has been sidelined in these negotiations have only stoked rumours of top-level political “intervention” and an opportunistic tactic by BN in view of its sinking popularity in Sabah.

The routinely positive hype whipped out by the local media over Sabah BN’s “growing popularity” mocks the ground reality prevailing in Sabah.

The fact is everyone from Chief Minister Musa Aman right down to the BN assemblymen is uncertain of their future, going into the 13th general election, and are desperately trying to engage individuals, NGOs and political nondescript persons.

To put it bluntly, Sabah Umno and BN partners – Liberal Democratic Party (LDP), MCA, Gerakan, MIC, Parti Bersatu Sabah (PBS), Upko and Parti Bersatu Rakyat Sabah (PBRS) – are collectively in deep trouble facing the upcoming election.

The famed BN “fixed deposit” is no longer applicable here. There are no longer any guarantees for BN.

Besides, the revelations heard at the Royal Commission of Inquiry (RCI) have shamed these party leaders for their spineless support of Umno’s agenda which systematically marginalised the native KDMs and Christians and turned hundreds of shocked fence-sitters into resolute opposition supporters.

The hearings have also stirred deep-set anger within the communities against the legalised illegal immigrants.

Such deep anger, if “strategically” fanned could force the hand of the government to clamp down on any civil unrest.

Bad prognosis for BN

Recent BN intelligence reports, although optimistic of Prime Minister Najib Tun Razak’s individual appeal, noted that the ruling coalition “could lose more than half” of its 25 parliamentary seats in Sabah.

Ground reports from the opposition have put their wins at between 15 and 18 seats.

These reports have also indicated that BN could lose just over half of the 60 state seats up for grabs in the 13th general election.

The prognosis for BN and Sabah Umno as such is not good. And Putrajaya or Umno cannot do without Sabah’s wealth.

Sabah is currently a politically volatile state for Najib and federal Umno.

Describing Sabah as a state “in chaos”, a university lecturer here, who declined to be named, said “people are just angry… watch the [ballot] box”.

He viewed the government’s approach to the latest “siege” as “stupid”.

"This is a security breach… If armed Singaporeans slipped into Johor Baru, would the authorities be this caring? Would they want to give it more time to resolve the matter?” he asked, alluding to Hishammuddin’s reported comment that the situation was “under control” and that the government “was giving it a little bit more time for this matter to be resolved”. Both Malacañang and the Department of Foreign Affairs (DFA) have consistently assured the public that the claim over Sabah is not a priority now for the Philippines.

    sekatan jalan diberberapa lokasi di Lahad Datu, tiada tanda-tanda bahawa
    kejadian pencerobohan di Kg Tanduo itu merebak di lokasi-lokasi lain.

  24. Kg Tanduo merupakan kampung yang terpecil dan berdekatan dengan Tanjong
    Labian, di mana kawasan ini suatu ketika hangat dibicarakan kerana
    pernah dipohon oleh seseorang kenamaan.

Polis menjangkakan rundingan pihak berkuasa dengan sekumpulan penceroboh rakyat Filipina di Kampung Tanduo, Lahad Datu sejak minggu lalu dapat ditamatkan dalam masa terdekat tanpa pertumpahan darah. ketika ini, proses rundingan antara kedua-dua pihak terlibat masih berjalan dengan dibantu Angkatan Tentera Malaysia (ATM) dari segi operasi pemantauan.

Masalah juga bila Malaysia dan Filipina x panggil Sultan Sulu semasa majlis perdamaian dengan puak2 pemisah Selatan. Apakah Sabah yang makmur & perkasa ini akan ditadbir oleh Kesultanan Sulu yang tiada negara?

    Masyarakat yang jahil akan `pukul borong` menyalahkan Najib selaku PM. sedangkan tugas ini mmg dipertanggungjawabkan kepada tentera.

  76. Kerajaan terus menjamin keselamatan rakyat menjadi keutamaan dengan menggunakan pelbagai pendekatan bagi menyelesaikan isu pencerobohan kumpulan bersenjata yang mendakwa sebagai Tentera Diraja Kesultanan Sulu yang berada di Kampung Tanduo, Lahad Datu, baru-baru ini.

    Menteri Dalam Negeri, Datuk Seri Hishammuddin Tun Hussein berkata langkah itu sekaligus menafikan dakwaan kerajaan bersifat sambil lewa dalam menyelesaikan kes terbabit berikutan isu keselamatan rakyat jelata.

    Beliau berkata, kerajaan mampu melaksanakan apa sahaja tindakan termasuklah menggunakan kekuatan tentera bagi menyelesaikan kes terbabit namun mengambil langkah pendekatan lain termasuk mengadakan rundingan dengan kumpulan berkenaan.

    Katanya, isu terbabit perlu diselesaikan dengan bijak bagi mengelakkan sebarang kejadian tidak diingini seperti mengorban jiwa atau sebagainya.

  78. Mengulas mengenai perkembangan situasi kes terbabit, Hishammuddin berkata beliau akan memberikan keterangan lebih terperinci sekembalinya dari daerah Lahad Datu pada sehari dua ini.

    “Setakat ini, tiada bukti kukuh yang mampu menjelaskan tuntutan kumpulan itu kerana tiada catitan sejarah yang secara jelasnya mengatakan bahawa Sabah merupakan milik kerajaan itu (kerajaan Sulu) suatu ketika dahulu,” katanya.

    Sementara itu, Hishammuddin menggesa agar rakyat tidak mempercayai sebarang spekulasi dan khabar angin berhubung isu kumpulan bersenjata itu.

  79. Beliau berkata, sekiranya khabar angin terbabit mampu menggugat keselamatan negara pihaknya tidak akan teragak-agak mengambil tindakan sewajarnya.

    Beliau turut difahamkan bahawa banyak spekulasi dan ‘cakap-cakap’ mengenai isu berkenaan termasuklah dari media antarabangsa yang menurutnya tidak semestinya sahih dan betul mengenai situasi sebenar di Lahad Datu.

    Oleh demikian, Hishammudin berharap agar rakyat khususnya penduduk negeri Sabah tidak terikut-ikut atau terpedaya dengan mana-mana khabar angin berkenaan isu ini melainkan kenyataan sahih daripada pihak kementerian beliau ataupun kerajaan sendiri.

    “Nanti bila faktanya didedahkan sendiri, anda semua akan melihat siapa yang menyebarkan khabar angin dan tidak berasas, lain kali kalau dia buat cerita jangan percaya.

    “Tunggulah kesannya, kita berlandaskan keselamatan. Kalau khabar-khabar angin itu boleh menjejaskan keselamatan kita maka tindakan akan diambil terhadap mereka.

    “Kita lebih berminat mengenai keselamatan pasukan keselamatan kita di Lahad Datu,” katanya mengulas kepada isu spekulasi berkenaan yang tersebar luas di laman-laman blog dan laman sosial sehingga menimbulkan pelbagai andaian daripada ramai pihak.

    Kerajaan dan pasukan keselamatan negara kini difahamkan dalam fasa menyelesaikan kes pencerobohan lebih 100 warga asing yang mahu dikenali sebagai Tentera Diraja Kesultanan Sulu di Lahad Datu pada Selasa minggu lalu dengan sebaik mungkin.

    Sehubungan itu, Hishammuddin menggesa agar isu berkenaan tidak dipolitikkan bagi mengambil kira isu keselamatan antara kedua-dua pihak termasuk pasukan keselamatan mahupun sekumpulan warga asing berkenaan.

    “Oleh demikian, saya harap isu ini tidak dipolemikkan atau dipolitikkan bagi memastikan keselamatan rakyat kita terus terjamin,” katanya.

    Muhyiddin puji kerajaan BN. Sabah turun kadar kemiskinan

    TENOM, 22 Feb (Bernama) -- Tan Sri Muhyiddin Yassin memuji kerajaan Sabah di bawah pimpinan Ketua Menteri Datuk Seri Musa Aman kerana berjaya mengurangkan kadar kemiskinan ke paras yang lebih rendah iaitu sekitar 8 peratus dalam tempoh empat tahun ini.

    Timbalan perdana menteri berkata dakwaan pembangkang, kononnya kerajaan Barisan Nasional (BN) Sabah gagal membawa pembangunan, ialah " fitnah dan pembohongan semata-mata".

    "Pembangkang sebut Sabah miskin, Sabah tidak ada rakyat yang maju, Sabah tiada kemudahan, Sabah tertinggal di belakang...ini ialah satu pembohongan," katanya ketika berucap pada Majlis Pemimpin Bersama Rakyat di Dewan Sri Antanom, di sini hari ini.

    Turut hadir ialah Musa, Speaker Dewan Undangan Negeri Datuk Seri Salleh Said Keruak, Timbalan-Timbalan Ketua Menteri Tan Sri Joseph Pairin Kitingan dan Datuk Seri Yahya Hussin.

    Rabu lepas, semasa mengumumkan keputusan awal Kajian Pendapatan Isi Rumah (HIS) 2012 bagi Sabah di sini, Ketua Pengarah Unit Perancang Ekonomi, Datuk Dr Rahamat Bivi Yusoff dipetik sebagai berkata kadar kemiskinan di Sabah berkurangan daripada 19.7 peratus pada 2009 kepada 8.1 peratus tahun lalu, penurunan tertinggi kadar kemiskinan yang dicatatkan dalam negara.

    Beliau berkata kadar kemiskinan di kawasan luar bandar mencatatkan

    pengurangan daripada 32.8 peratus pada 2009 kepada 12.9 peratus tahun lalu, manakala di kawasan bandar, angka itu berkurangan daripada 9.8 peratus kepada 5.3 peratus. Rahamat Bivi juga dipetik sebagai berkata hasil kajian HIS 2012 itu menunjukkan pendapatan isi rumah purata bagi Sabah pada 2012 meningkat kepada RM4,013 sebulan berbanding RM3,102 pada 2009, peningkatan 29.4 peratus dengan kadar pertumbuhan purata 8.6 peratus setahun.

    Muhyiddin berkata: "Sebagai timbalan perdana menteri, saya telah menjelajah banyak tempat di negeri Sabah dan saya tahu situasi dan keadaan sebenar."

    "Sebab itu, kita hendak tentukan supaya kerajan BN yang ada dasar, semuanya hendak membantu rakyat, mesti disokong, dibantu dan diberikan sokongan oleh segenap peringkat rakyat di seluruh negara," katanya.

    Dalam hal ini, beliau berkata kerajaan persekutuan pimpinan Perdana Menteri Datuk Seri Najib Tun Razak telah mengambil pelbagai inisiatif termasuk Program

    Transformasi Kerajaan untuk membantu rakyat.

    Ini termasuk program mengurangkan kadar jenayah, menghapuskan rasuah,

    menyediakan pendidikan yang berkualiti, meningkatkan pendapatan rakyat, menyediakan kemudahan asas, memperbaiki sistem pengangkutan dan menangani masalah kos hidup, katanya.

    Timbalan Pengerusi BN itu turut mengingatkan rakyat Sabah khususnya di

    kawasan pedalaman supaya membuat keputusan yang bijaksana pada pilihan raya umum yang diadakan tidak lama lagi bagi menentukan arah tuju masa depan Malaysia.

    Katanya pilihan terbaik untuk rakyat Sabah ialah kerajaan BN yang terbukti kemampunannya membela nasib rakyat.

    "Pilihan raya akan datang amat penting bagi negara kerana kuasa yang telah diberikan rakyat kepada BN akan kita kembalikan kepada rakyat selaras dengan amalan demokrasi berparlimen.

    Untuk pengetahuan pemimpin-pemimpin serta media pro pembangkang, kerajaan Malaysia sejak dulu lagi telah menggunakan konsep kesederhanaan dalam menyelesaikan konflik dan krisis yang melibatkan masyarakat antarabangsa. Jika pembangkang tidak suka dengan cara ini, bermakna memang benarlah bahawa pembangkang terutamanya Pakatan Rakyat lebih gemar menggunakan pendekatan kekerasan, kekejaman dan huru-hara untuk menyelesaikan sesuatu masalah. Maka, tidak heranlah perjuangan Pakatan Rakyat hari ini lebih banyak berkisar mengenai demonstrasi jalanan berbanding dengan aktiviti turun padang membantu rakyat yang sangat memerlukan bantuan.

    Konsep kesederhanaan ini terbukti berkesan dalam menyelesaikan konflik di selatan Filipina apabila Barisan Pembebasan Islam Moro (MILF) dan kerajaan Filipina bersetuju berdamai setelah kedua-dua pihak mengambil pendekatan kesederhanaan yang disarankan oleh Malaysia. Malaysia juga mengambil pendekatan serupa dalam isu keganasan etnik dan agama di negeri Rakhine, barat Myanmar dengan menekankan soal kemanusiaan dengan memberi bantuan kepada mangsa keganasan di Rakhine tanpa mengira latar belakang dan agama mereka. Begitu juga dengan peranan yang dimainkan oleh kerajaan Malaysia dalam membantu menyelesaikan konflik di Syria.

Jesteru, penyelesaian yang berbentuk kemanusian adalah perlu selagi ada ruang dan peluang untuk berbuat demikian.

  167. If the British version of the 1878 Treaty is adopted, it is, therefore, clear that the sovereignty over Sabah has been, since 1878, transferred by the sultanate of Sulu to the British, which later, under the concept of utti possideti juris, to Malaysia.
    In addition, under international law, prescription refers to acquisition of sovereignty by way of actual exercise of sovereignty, maintained for a reasonable period of time that is effected without objection from any state.

  168. Even if the British version is contested and the Sulu version of the 1878 Treaty is upheld, the sultanate may not be able to claim sovereignty over Sabah as Malaysia has, since 1963, exercised prescription and administered Sabah without any consistent objection from any members of the UN.
    Malaysia's exercise of sovereignty over Sabah is different with that of Indonesia in relation to Timor Leste. Timor Leste was annexed by Indonesia in 1975.

    This could be seen in the 2002 International Court of Justice decision, which awarded the islands of Sipadan and Ligitan located off Sabah, which were disputed by Malaysia and Indonesia, to the former. This decision has strengthened the fact that Sabah has always been part of Malaysia.

    In the Malaysia-Singapore dispute over Pulau Batu Putih/Pedra Branca, the ICJ initially recognised the sovereignty of Pulau Batu Putih/Pedra Branca was with the Johor sultanate.

    This basically shows that as far as this matter is concerned, the claim of ancestral territory does not carry much weight under international law.

    The continuous display of control by Singapore government over Pedra Branca and Malaysia over Sipadan and Ligitan superseded historical claims over these territories.

  174. It is true that historically, Sabah was part of the Sulu Sultanate. Nevertheless, the political scenario of Sabah and the Philippines has changed since the Spanish, the British and the Americans came to this part of the world with the aim of colonisation.
    Sabah is now part of Malaysia and has been progressing well towards development and modernisation, consistent with Malaysia's vision to become a developed nation by the year 2020.

  175. Indeed, the relative prosperity of Sabah has turned it into a gold-mine for most non-Malaysians residing in the state. If not for Sabah's fair economic achievement, the sultanate of Sulu would not put a claim on Sabah.
    Regardless of the Sulu claim, the international community has acknowledged Sabah as part of Malaysia and it will remain as such. In this respect, the claim of Sabah by the sultan of Sulu could be seen as a reminiscence of a long-los' sovereignty.
